A developer against Network Rail

House Maker (Padgate) Ltd v Network Rail Infrastructure [2022] EWHC 1482 (TCC)

What happened
Drainage on Network Rail’s land flooded our client’s site next door and held up a planned housing scheme for two more years.
What we did
Sued for the lost profit. The High Court used the case to develop and define the “measured duty” a landowner owes its neighbour.
The result
A substantial six-figure sum for lost profit, plus legal costs. The client kept the land and is free to build.

£140,000+claim defeated at trial

Homeowners sued by their installer

Two private clients

What happened
An installer sued our clients for more than £140,000 over a home automation system that never worked as specified.
What we did
Filed a defence and counterclaim, and made tactical without-prejudice offers along the way.
The result
The claim failed at trial, the counterclaim succeeded, and the judge ordered 90% of our clients’ budgeted costs as an interim payment.

3 daysin the High Court, won in full

A home taken by fraud, recovered

A private client

What happened
Our client had been deceived into signing documents that transferred her only property, her home, to the defendant.
What we did
Claimed a declaration of ownership, correction of the Land Registry title and an order for possession.
The result
The whole claim succeeded after a three-day trial, with indemnity costs ordered against the defendant.

Four questions to ask any law firm

Ask them of us first. Then ask the next firm you speak to.

  1. Will I know the fee before you start?

Yes, in writing. Our prices for moving home, probate and unpaid invoices are published, and every other matter gets a fixed fee or a written estimate before any work begins.

  2. Who will actually handle my case?

A named solicitor, with the head of the department behind them. You will know their name, number and email from the first day.

  3. How quickly will you get back to me?

Within 2 working hours on a weekday, and with an update at every stage after that, whether or not anything has moved.

  4. Where can I check you’re regulated?

On the SRA register (SRA 547596), the Law Society’s Conveyancing Quality Scheme and the FCA register (918333).

No surprise fees. If the work changes, we agree the cost with you before we do it.

Your first call is free and there is no obligation to instruct us.

Questions people ask before they call

Anything else, ask us on 0345 901 0445.

How much will it cost?

You get the fee in writing before any work starts: a fixed fee where the work allows it, or an hourly rate with a written estimate where it doesn’t. Our published prices cover moving home, probate and unpaid business invoices, and the fee check on this page works them out for you.

Is the first conversation really free?

Yes. Your first call is free and there is no obligation to instruct us. We can meet in Hale or Mayfair, or talk by phone or video if you would rather not come in.

How quickly will you get back to me?

We call back within 2 working hours of your enquiry, Monday to Friday. If it is urgent, ring 0345 901 0445 and say so.

Do you only act for clients in Manchester?

No. We act for businesses and individuals across the UK and abroad from our offices in Hale, south Manchester, and Hill Street, Mayfair, in London.

What if the cost changes once you start?

We tell you before it happens and agree it with you first. If something unexpected comes up, such as a defective title or a debtor who disputes the claim, we explain the extra work and what it costs before we do it.

How long will my matter take?

We tell you at the start, and our published prices give the usual ranges: an undisputed business debt typically takes 1 to 10 weeks, a straightforward probate 3 to 6 months, and a freehold sale or purchase several weeks.

Are you regulated, and where can I check?

Yes. Blackstone Solicitors Limited is authorised and regulated by the Solicitors Regulation Authority, SRA number 547596, and our residential conveyancing is accredited under the Law Society’s Conveyancing Quality Scheme. Both registers are linked at the foot of this page.

Do you act for employees or employers?

Both. Our employment department, led by Natasha Jones, advises employees on settlement agreements, dismissal and discrimination, and employers on tribunal claims, redundancies, TUPE and day-to-day HR questions.
