Employment Rights Act 2025

The law is changing. Here’s where it stands.

The biggest overhaul of workplace rights in a generation is arriving in stages. Three dates matter most right now, for employees and employers alike.

  1. In force

Six months to bring a claim

Time limits for most employment tribunal claims double from three months to six, where the dismissal or act happened on or after this date.

  2. Coming soon

A tougher duty to prevent harassment

Employers must take all reasonable steps to prevent sexual harassment, and can be liable for harassment of staff by customers and other third parties.

  3. Coming in 2027

Unfair dismissal rights after six months

Employees gain protection from unfair dismissal after six months’ service instead of two years, and the cap on compensation is due to be lifted.

Employers: is your business ready?

Probation periods, contracts, policies and harassment training all need a fresh look before January. We’ll review them with you.

Employees: has something changed for you?

Longer time limits don’t mean you should wait. Evidence fades and options narrow, so get advice while every route is open.

Questions

Straight answers to common questions.

Can’t see yours? Call 01604 700099 and ask a specialist.

How much will it cost?

Your first call is free. After that, it depends on what you need:

  • Settlement agreement advice is usually covered by your employer’s contribution, under our Cost Guarantee.
  • Employees can use a fixed-fee consultation, No Win No Fee for eligible claims, legal expenses insurance or private funding.
  • Employers can have a clear quote for a single matter, or HR Plus from £99 + VAT a month.

See our costs

Do you offer No Win No Fee?

Yes, for eligible claims. After an initial assessment, sometimes a fixed-fee review of your documents, we’ll tell you whether your case qualifies. Not every case does, and we’ll always explain why.

How quickly can I speak to someone?

We aim to reply to every enquiry within 24 hours, Monday to Friday, and we offer same-day appointments for settlement agreements. If it’s urgent, call us on 01604 700099.

How long do I have to make a tribunal claim?

Time limits are strict. Where the dismissal or treatment happened on or after 1 October 2026, most claims now have a six-month time limit, and you must contact ACAS for early conciliation before you can make a claim. For earlier events the old three-month limit usually applies. Speak to us as early as you can.

Do I need to visit your office?

No. We advise clients across the UK by phone and video. If you’d like to meet in person, our office at Grange Park, Northampton is minutes from junction 15 of the M1.

Do you act for employers as well as employees?

Yes. We advise both, which means we know how the other side thinks. We never act for both sides in the same matter.

Are you regulated?

Yes. Astons Solicitors is the trading name of Astons Legal Limited, authorised and regulated by the Solicitors Regulation Authority, SRA number 538039. You can check our entry on the SRA register.
